Terms of Sale — Thierry Colson

These General Terms and Conditions of Sale govern purchases made on thierrycolson.com. They apply to private individuals ("the user") and exclude professional buyers/retailers.

Company

These conditions are concluded between TC Consulting, trading as Thierry Colson ("Thierry Colson"), and the user. The parties agree their relationship is governed exclusively by this contract. Where a clause is silent, the practices in force in the French distance-selling sector apply.

Object

These conditions define the terms of sale between Thierry Colson and the user — from order placement through payment and delivery.

Order

An order implies acceptance of the prices and product descriptions in effect at the time of order. Thierry Colson honours orders within the limits of available stock, and will inform the user if a product becomes unavailable.

Thierry Colson reserves the right to cancel or refuse an order if the customer's IP address is located in a country different from the billing and/or delivery address, as a fraud-prevention measure.

Shipping & Delivery

Shipping costs, delivery times, carrier, and country-by-country rates are set out in our Shipping & Returns policy, which forms part of these terms by reference. Transport risk transfers to the customer once the product leaves the warehouse; Thierry Colson cannot be held liable for delays beyond its control.

Customs & Duties

International orders are subject to destination-country duties and taxes, for which the customer is responsible. Full terms, including the consequences of refusing a shipment, are set out in the Shipping & Returns policy.

Rates, Payment and Billing

Prices are quoted in euros, all taxes included, at the VAT rate applicable on the day of order. Shipping and packaging are not included in the listed price. Prices may change at any time, but never after an order has been placed. The final price charged is the price shown on the order confirmation page.

Accepted payment methods: Apple Pay, Visa, Mastercard, and PayPal. An invoice is included with every parcel.

Right of Withdrawal, Return and Exchange

Eligibility, request windows, return address, and refund timing are set out in our Shipping & Returns policy, which forms part of these terms by reference. Please consult that policy before requesting a return or exchange.

Guarantees

All items carry a contractual warranty, in addition to the legal guarantee under Articles 1641 et seq. of the French Civil Code, and the guarantee for defective items under Articles L211-4 et seq. of the Consumer Code.

Signature and Proof

The credit card number provided online and the final order confirmation constitute proof of the order under the French Law of 13 March 2000, and render the corresponding sum due and payable. Validation is equivalent to signature and express acceptance of all operations carried out on the site. Thierry Colson is bound by an obligation of result at every stage of order processing and undertakes to describe products with the greatest accuracy. Thierry Colson's liability cannot be engaged for non-performance due to unforeseeable and insurmountable acts of third parties, force majeure as defined by French jurisdiction, or inconveniences inherent to internet use (service interruption, external intrusion, viruses).

Security and Confidentiality

All information transmission is secured using standard internet protocols. Thierry Colson does not store credit/debit card information; this is held on our payment provider's secured server. Personal information collected for order processing is shared only where necessary (bank, carrier) or where legally required. Full detail is set out in our Privacy Policy.

Severability

Should any clause of these terms be rendered void by a change in legislation, regulation, or court decision, this does not affect the validity of the remaining terms.

Archiving

Purchase orders and invoices are archived on a reliable, durable server in accordance with Article 1348 of the Civil Code.

Governing Law and Amendments

These terms are governed by French law. In case of dispute, jurisdiction lies with the court of the defendant's place of residence or, at the plaintiff's choice, the place of actual delivery.

These terms may be amended from time to time to reflect new laws or regulations. Updates take effect upon publication on thierrycolson.com.
